My understanding is that this was the issue which finally prevented Forest from access to the BHP or RIO rail lines to transport his iron ore. He could not get insurance he could afford to cover the liability for damage which would prevent the owners continuing with their business in the case of an accident. By the way, public liability insurance would not cover the liability for damage to an asset of another owner where access is asked for and granted.
