How is that any different to realising a capital gain on a share that hasn't undergone a rights issue? If you bought yesterday and sold today you could buy the rights at 28.29 but you have still made a loss on the trading of the normal shares. If you "bought well before", with the assumption being that you bought at a price lower than yesterday's close, you could just have easily sold the shares yesterday.
How is that any different to realising a capital gain on a share...
