I am going on the assumption that there was a binding contract.

If so, that contract will go with the plant to its new home so we would expect the ore to be treated there. The sale and purchase agreement for the plant will have to account for the binding contract.

If not, there will be non-compliance with the terms of a binding contract and that will have legal ramifications.

So maybe not too binding .....probably a answer that needed further scrutiny in question time...
