If a patent is applied for, then lapses the information is then public so another company can use it. that other company wouldn't be able to patent it however. So surely in this case neither company can patent the process and it is therefor free for all companies to use. RNU can't patent it (noting that they haven't tried to do so) but surely neither can EGR as the information has spent time as freely available to the public.
Where you write "claim as our own" surely that statement would only be correct in the event that they had tried to patent the idea. Which surely they looked into but could for the reasons stated above.
