    Let me play Devils advocate here. Let's say the government succeeds in pushing through legislation which redefines 'consultation' to a point where MEL will never succeed. Now I realise this would be a shocking law that effectively opens the way for abuses but I'm not putting anything past this government.

    The government then issues MEL with a suspension notice and allows procedural fairness under the new regime. Upon submitting their response their suspension is upheld and MEL is up the creek without a paddle. No compensation required beyond what is owed from the current ruling.

    I'm a legal layman, so I'm willing (and hoping) to be corrected here. But is that not a possibility?
