Not sure that I would agree with this characterisation. Broadly, ASX is trying to extend discovery across the board, ISX is trying to limit it. It goes without saying that the court is more inclined to erring on the side of discovery that in hindsight is overly broad in scope, rather than the alternative.
None of these rulings have any bearing on the case to be heard, more the burden of producing documentation, on both parties.
