I mean imagine if ISX attended ASIC offices on the 2nd October 2019 and ASIC told ISX BOD that there was NO open investigation at 1 PM.

Well now that ASIC has put it in writing in their latest reply as of yesterday WHEN the investigation OFFICIALLY STARTED. This should play out very well in court. Once the emails confirm all the timings

There's almost an inconsistency. They only seem to reconcile if either (a) ASIC was mute about ASX's suspension proposal, or (b) at the time of the consultation it had not decided to investigate but was inspired to do so later in the day. Defies the ASX credibility.
