Wrong, wrong, wrong!!! 1. Whether there's a correlation between SOI and SP is irrelevant. 2. This is exactly the scenario, and no other.
1. Correlation between SOI and SP On the market, buyers and sellers set the SP. The ASX do not say to buyers "buy at this price" and sellers "sell at this price". So it is not responsible for the execution price. It simply doesn't care as it makes a commission on the trade irrespective. What it does care about is who the sellers are - as it performs the matching function. Buyers do not choose "I want to buy xxx shares from that particular seller". That's the ASX's job, so ASX is 100% responsible. If there's a mistake here, ASX need to correct it.
2. The scenario We all know ASIC are investigating the validity of the perf shares. It was in the court transcripts. The scenario I've drawn is exactly what we are dealing with. I have no idea where you get this ludicrous thought that "no one else has an issue with the perf shares".
