I agree with you on the suspension somewhat, I feel ASX has the power to do what they want their to some degree. Although not sure how the judge will view ASX setting directions and not relisting ISX when they’ve completed them (not sure any person anywhere could view that as reasonable behaviour. I think setting those directions makes any listing rule breaches at suspension largely irrelevant as that’s the punishment). I think the ASX releasing the SOR, is a completely different can of worms though. Where does any listed entity sign up to the ASX being able to release unproven opinions that damage the company? And even if the listing rules allow it I think their will be clear elements of natural justice that challenge that. ASX didn’t have to release that report and their own defence says they don’t have the proof to back it up.
