Folau has a right of internal appeal to a differently constituted tribunal, however the result would likely be the same as a disciplinary tribunal has very limited powers. I predict he will give an appeal a miss and will apply directly to the Court which has jurisdiction ( presumably the Supreme Court of NSW) and seek redress there. Courts are able to consider, interpret and apply legislative and contractual provisions, as well as equitable remedies, that the tribunal could not. For a start, RA clearly denied him natural justice by pre-determining his guilt and penalty before he was even given a chance to answer the charges. The coach also pre determined guilt by stating he would never be selected.
