IANAL. My reading of insider trading law in Australia would indicate ML could be in trouble only if information was released privately to select people, giving them an advantage. But there are exclusions in place for "publishing" information - which would presumably apply to, say, an investigative reporter uncovering something not known to the public. Nobody gets to say "but The SMH is behind a paywall" in that scenario, so I think the "some people aren't on twitter" argument carries no weight. So I guess it all centers around his role as a consultant and the definition of "confidential".

No, market sensitive is a development in the company that materially affects the share price on an ongoing basis. A photo tells you nothing. Let's assume the assay are worse than expected - that's material information and should be disclosed. The photos have created excitement because there's been no company announcement for sometime but what only matters is what the samples reveal! The company is not required from legally to announce anything. It's job is not to pacify shareholders because they expect announcements. Please pay me some respect. I appear to waste my time on this forum. Why do I bother!
