its not as black and white as 2 year and you are delisted. The rule is open to ASX consideration but it is fair to say we can probably go until July next year before we are delisted.
But July is 7 months from now at which point ICC and provisional ICSID claims are all closed
-Dathomir is partially resolved Dec 19th and thereafter march 2024 -Zinjin resolved Jan 2024
Leaving the main issue of ownership and mining license per the DRC mining code.
Both of these are resolved by the ICSID outcomes which we know are provisionally securing ownership and stopping activity at site now.
Thereafter either DRC will be quick to act and sign an MOU or we will need to stay the course for compensation.
ICSID takes 14 months on average to resolve so this outcome would delist us but given the site is stalled, the ownership stays with AVZ, DRC needs worlbank support, China has a bad track record in DRC, Western world wants supply chain certainty, Felix wants Battery Hub - Why would DRC prolong this project any further if ICSID has ruled in favour of AVZ and all site activitiy is done - This news next week in my opinion.
It is clear Nigel is willing to compromise now and with Felix as his key negotiating stakeholder, after election - Felix and the DRC will look for some sort of immediate issuance of mining license in return for relinquishing the northern area. In return AVZ i expect with a strong legal case, Nigel with 50m shares at stake, and shareholders demonstrating strong support - Will seek a good outcome for the northern area (i.e. 15% as zinjin just did when they relinquished 15% in dathcom in return for the northern area). This deal is fine and i am supportive
