It has a basis. It is based on a legal precedent set by the USA and NATO where 'humanitarian intervention' is a perfectly legally justifiable course of action. It is ambiguous and it is based on the interpretation of the need for the humanitarian intervention by the country planning to intervene. Ambiguous but not illegal, apparently.
