It is as permissible as Russia flying in international waters 200 km or so from USA recording possible missile target locations. The only difference is the target locations NATO are recording are getting acted on with actual missiles.

The transponder was supposedly turned off so if it were to be true, USA would not admit to it. And Russia would keep quiet as to not make it an international incident and force USA to need to respond or look weak.
