It was the police who withdrew the charge...not the magistrate who dismissed it. The "offender" stayed at the scene and didn't attempt to flee, which someone who has just been seen by the father trying to abduct a child might be expected to do. The magistrate appears to me to be saying there are too many doubts on the facts of what the Afghan man's intentions were for a conviction to be likely.
