The magistrate didn't dismiss the charges, the police withdrew them. The magistrate advised the police that "If he was hearing the charges" (IE the case may not have been his), he would have reasonable doubt in relation to a guilty finding. The police withdrew the charges after the magistrate's hearing. It seems to me there was deemed (ultimately by the police...they had the right to proceed) that there was insufficient evidence the man was abducting the child.
