what were the charges dismissed on the grounds of cultural differences?
child abduction? assault by hand holding? kidnapping? attempted child sexual assault?

Now he has prior convictions and to many of you that makes him guilty and shouldn't be let off for cultural differences

BUT what if the cultural difference is that Afganiis have talking,walking even touching any children as a cultural 'norm'?
I'm not talking rooting children just chatting/relating with them 'innocently'.

Now we in Australia used to have this cultural norm but it's been conditioned out of us to the point that sypaladin 'corrals' a run away child in the street as a responsible adult yet wouldn't dare restrain the kiddie physically.

What if she had been more wilful and tried to dodge our sypaladin causing him to dare to lay hands on her and right at that point her mother came out to see sy a stranger clutching her precious..wouldn't the scream for the police come out of Mum? A scream so virulent that the police may lay charges of assault,kidnapping,attempted child rape even.

Do you see the parallels? If sypaladins behaviour can not be seen as within a cultural norm,as children are raised in a village pre Dr Spock theory
but instead he's charged with unauthorised touching of a child with no 'reasonable' excuse/defence allowed ?.


look this Afghanii is the most vile perpetrator to have this 'cultural difference' defence applied to but the law must try to be impartial with various elements of the offence to be proved and not refutable.

If the Law is that Anyone who touches or even speaks to a 'strange' child no matter what the circumstances? well for example sypaladin would be so charged.

The magistrate at the committal stated that the charges would fail for lack of evidence because the behaviour could be explained as cultural differences within a reasonable doubt.
The Prosecutor/Police then withdrew the charges because the elements necessary to bring to trial were not there.

If sypaladin had his charges so dismissed it'd be because he exhibited normal,adult care of a runaway child
