DJ Australian Regulators Reject Qantas Bidders Appeals
SYDNEY (Dow Jones)--Australian regulators Monday refused two appeals by the consortium
bidding A$10.82 billion for Qantas Airways Ltd. (QAN.AU), confirming they wouldn't
allow its offer to proceed.
The Australian Securities & Investment Commission said it had decided to refuse
applications from the Airline Partners Australia consortium to overcome the effect of the
failure of the bid to reach 50% acceptances by the 0900 GMT Friday cutoff of the A$5.45
per share bid.
The Takeovers Panel also said that following a review Sunday, it wouldn't reverse
a decision not to allow the late acceptance of the offer by an investor holding 4.96% of
the airline.
APA had sought an appeal of the panel's decision not to declare a situation of
unacceptable circumstances under the offer, after saying an offshore investor had lodged
its acceptance of the offer around five hours late.
