In one of my previous posts which you TOU'd Bob (so readers did not get to see it), I mentioned that the drafters of the Corporations Act 2001 got it right when they penned s249D allowing shareholders to replace 'incompetent' (my term) Board members ....

Where the drafters came short was in not allowing a company to cast off a serially litigious shareholder. One failed strike and you've had your turn I say ....

(unqualified legal question ... but is there a case to raise a class action (by the majority of shareholders) against a serial pest for diminishing the value of their investment by repeated attempts to effect an outcome which has previously failed and been shown to be ineffective and unsupported by the majority of shareholders ??? Worth thinking about that .... ?
