Considering Freeport just took a $600m+ hit to close off the related contracts, I would think it is very much in their interests to finalise this quickly, considering it is likely to amount to a small fraction of that amount.
The Force Majeure gambit sounds like an attempt to protect a weak position, but won't amount to much.
