My understanding is that whilst the cup section should ideally have equal highs like you said, this might not always be the case...particularly when there is a lot of volatility.
I personally think that it looks to be a cup & handle formation, perhaps not a text book perfect one with equal highs. The literature behind this type of formation recognizes that equal highs need not always be the case.
