Kgtom is completely correct .. You can sell for the specific reason of " attempting to claim a loss " ..The Loss will be dissallowed . You cannot sell for the specific reason of obtaining a loss .. you may however sell and decide for " other reasons " that the stock may well be profitable . Make a note of your reasoning , in writing as to your actual intent , include this in your file and always assume an Audit .. have all your answers ready for each relevant transaction.
