I would rate the chance of FAR keeping the whole 35% as just about zero. 5% on the other hand I would rate as very high. On-selling 30% at say $6 per barrel raises about $1billion less what WPL paid and expended so far would leave FAR with enough $$$ to go to production.
Got to win first though.
