    Good question. Most of the discussions I have had with CUR, indicate to me that they do expect the Court case to go in their favour. However this is not factored into current valuations, ie. no downside risk online upside on a favourable outcome.

    I understand your concerns re the merger/takeover. On a more liquid stock I would agree that a higher valuation is in place. I guess this the tradeoff in investing in these stocks. The deal sure's up CUR for the future, so what it is doing is removing the risk of CUR running out of money and going broke. As a long term investor I am happier to see my downside removed in exchange for a more secure upside.

    Just my view, I will be supporting the proposal.
