5.2 Waiver of Bid Conditions and extension
(a) Except as otherwise provided by the Bid Conditions and item 3(b) of Schedule 2
and subject to the Corporations Act, BC Iron may declare the Takeover Bid to
be free from any Bid Condition or extend the Takeover Bid at any time.
(b) Notwithstanding clause 5.2(a), BC Iron will not declare the Offers free of the
condition set out in item 4.7 of Schedule 2 without obtaining the prior written
consent of IOH (which must not be unreasonably withheld).
