This such a dumb arse argument, if it's unwanted it's harassment. Guys are usually more acceptable of approaches by women, as simple as that. If a woman pinched your butt would you want to sue her? You have real issues of you did.
If you pinched a womans butt it's totally up to her whether she accepts it or not, so best you choose your butts carefully. Equality doesn't translate to turning women into men and vice versa.
