They got talked out of it but went ahead and are now shouting 'misrepresentation'?
When I bought our little house I had a survey done. The surveyor was a bit late delivering the results (I think his wife had a bout of flu if I recall correctly, but he was the expensive expert whose opinion I sought, so I thought it best to wait till she was feeling a bit better).
If I had gone ahead and bought the house without the final survey, but with the nod from the estate agent that it was all fine, I do wonder if a judge would say I was swindled or stupid the morning after the roof fell in?
(p.s. I'm not a lawyer so this is all speculation on my part: it may be quite normal to 'go with your gut' on business transactions of this size)
