While that is somewhat true, i think there's a bit more to it here. After Justice Lee's findings regarding the political cover up angle, Sharaz has probably had to resign himself to losing and losing badly at trial.
I'm no legal expert but you can't just get out of a defamation action by saying "ok, you win", either their lawyers will come to a settlement or it will be left to the judge to decide on damages and costs in an uncontested case. I wonder how long till Brit follows suit, the pair of them deserve all that's coming
