I haven't been able to find the exact rules concerning the requirement to halt a buy back when in possession of price sensitive information. Comments regarding blackouts are related to annual results and those kind of financial summaries. It's possible they realised they were hitting some strong resistance with the negative biotech sentiment and prefer to purchase more shares at a lower price with the knowledge that good news will arrive soon enough and the cheaper you get shares with your $50 million now, the bigger reward in the future. Of course it's just one possibility.
