So instead of them saying "sorry TGA testing failed" they said "We are pleased to announce TGA gave an exemption". Unlikely to the point of lets hope our stupid SH don't notice. Anyway proof in the pudding will be when they have to produce all communications and documentations regarding that discrepancy, accounts on transactions and agreements with distributors, product disclosure and failures to disclose for the enquiry.
