Georgeson is a proxy solicitation firm which is a subsidiary of Computershare. The caller is from Georgeson not from the Share registry itself, despite bizarrely trying to fudge it, and they really should not be holding themselves out as such. Otherwise it’s a clear case of misrepresentation and deception under the most basic consumer law. If he/she is doing so on the direction of their client, then both of them could arguably be in the frame for a deliberate scheme to deceive in order to influence voting outcomes. I don’t think a court would look too kindly on this aspect, either in isolation or as part of a wider claim over 249D fallout.
It would be a bit like the Morila mine village cleaner calling up Van Eck to discuss their shareholding and claiming to be calling from Firefinch.
