Probably not if one party, i.e. the calling party, is committing a crime. I certainly had no problems with the police when I had recorded threatening phone calls. (The "genius" threatener used a mobile phone which he carried around with him. Police matched its device ID to pictures of him walking through train stations. A known criminal with a history of attacking police. Don't think that worked out too well for him.)
