Some of the posters who accuse Mozz or 'fanboys' of being too positive are equally guilty at themselves at the opposite extreme.

It's not that difficult to see it is reasonable to put negotiations on pause while there are still so many variables.
The parties involved might (understandably) want to know that we do get the green light to proceed, and under what conditions/restrictions/ additional requirements. It looks like common sense to me. Sticking in a 'subject to' clause would be incredibly cumbersome and risky given that the FDA could pull a number of unexpected requirements out of thin air.
