A rather draconian view....people assumed guilty because they bother to explain their subject position...
A similar approach was adopted during the great witch hunts during the 13th to 17th centuries. One of the ways women were proven to be guilty of practising witchcraft was to throw them into a body of water. If they sank to the bottom and failed to emerge they were considered innocent...albeit dead but nonetheless innocent.
Conversely, if they tried to save themselves and swam to the surface they were deemed guilty and burnt at the stake...
Not much of a choice....
