There is only a signed MOU, which gives the option to off take all ETM products, almost like an option security where it guarantees sales if no one wants it. Noting EU still don't have processing abilities for REE, they can't even process the REE despite feeling the need to stop China due to US China relationship. in reality, EU and China are not competitors, EU economy still rely on traditional industrial products like petrol cars, China is already the largest EV producer, it's more of a political issue rather than competition.
