Actually that is incorrect, everyone has a responsibility not least the company dispatching the goods, they have a responsibility to ensure it is safe to depart. I could put the national code up but this story gives it easier.

As for bulk shipping a loading plan is agreed upon between the parties and responsibility lays with both parties, as for who pays for costs if loading deviates would come down to who is deemed to have made the deviation from the plan. The master is responsible for overall loading as only he can complete ballast transfer, compartment balancing etc but he relies on correct information from the loader in regards to tonnage etc.

Its all a mute point.
