If they were that would be fine. But they aren't just taking a punt. They are using the advantage they have in financial resources and high frequency algorithmic trading between separate entity accounts (that are ultimately controlled by the same person) to manipulate the share price with internal cross trades that never see the market. They take a position and then actively try to make it come true. Sometimes I think they also coordinate with other short traders to attack the share price of particular stocks. It may be technically legal, but it isn't what most investors would regard as fair.
