No doubt, it would be. But then who is going to take any enforcement action if it is? There needs to be an appetite to do so AND there needs to be sufficient evidence to prove the matter to the required legal threshold. I would question whether either exists, and certainly the latter point is particularly challenging.
In any case, my original comment was simply trying to clarify what I believe another poster was suggesting in their own post that seemed to have subsequently been misinterpreted/misunderstood by someone else.
