Whoever lends the 40 million shares is in a very good position. They get a fee for lending their shares and they get the shares back when the shorter is finished. If the shorter is successful in forcing the price down, the lender can buy more shares (at a lower price) knowing that the shorter has to eventually buy the borrowed shares back.
