    The only hope now is if White Energy can overcome the financial hurdle. If it can the grounds for an Appeal if allowed, is if they can argue that the rising price of thermal coal from mid-2012 would have made the operation at Tabang more profitable leading to its eventual expansion. After all, the SICC case did start in mid-2015. Was SICC in error not considering this matter properly?

    Oxus Gold Limited lost the case in December 2015 but was still awarded US $10,299,572 plus interest. SICC in my view failed to take this case into account and may have been in error.
