    When you say 3rd party, I assume the 3rd party that covers damage to another vehicle (not 3rd party injury).

    In this case the 4wd is clearly in the wrong as he needs to leave sufficient room to stop in an emergency. Your son will need to contact the other party and request his insurance details to make a claim. I would suggest ringing his insurance as they are usually pretty helpful with advice concerning this.

    If the guy doesn't supply insurance details, get 3 quotes and send him a request for payment.

    If still no luck, may result in a civil dispute.

    I had a crash at a shopping centre once. Was backing out at same time as vehicle opposite. my 4wd had nil damage, the other car had a lot..

    I rang my insurance and they said both vehicles were to blame and as I had no damage, they didn't want to know about it. I can only assume the other party claimed through their insurance (actually they had a loan vehicle while their vehicle was being serviced. They said the excess was $1000 ... Ouch). I actually did feel bad that I got away with no damage... Never heard anything back from them.
