It depends on what the finding re: their maintenance is.
Pure speculation and just my opinion based on the culture of pretty much everywhere I've worked - WH&S is often seen as BS but you still tick&flick and do whatever checklist you're meant to do because someone higher up gets annoyed if you don't. That means the standard might be low, but they've met the minimum requirements.
The Thunder River Rapids ride completed an annual safety inspection only about 4 weeks ago, my understanding is that that is an independent check so if it wasn't done right it's probably not AAD's fault. Also the documentation we've seen out of Queensland Workplace Health & Safety so far looks like there's a history of very minor issues being raised by the regulator but no serious issues ever flagged and no instruction or direction to fix/improve something not complied with.
I predict there will be an in-depth investigation which will eventually conclude that AAD could no doubt have done better, but they weren't negligent and so aren't liable.
