While a re-opening of the tender process would not be anywhere near as good as a AVQ win, it may not be the worse result either and could effectively be seen as a win for AVQ. With the rightful landowners on AVQ's side, the landowners would be expected to accept only AVQ's tender.
SMM still have the maximum number of 3 tenements and therefore unless the SI government changes the rules, SMM will be ineligible to tender which is probably why the SI government, without admitting they made a mistake, took the LOI off SMM in the first place.
SMM are basically taking on the SI government and AVQ has been dragged into the mess. Normally if there is an abnormality with the tender process in Australia it goes back out to tender so that all parties start again on equal footing. What you say makes very good sense as a mistake is recognised, nothing can change that now, and back to tender we go. Not all parties will be happy but they won't be all that upset either.
