my accountant argued with the broker ( one of the big online brokers) that it was the same owner , but the broker said under their "rules" they had to do an offmarket transfer ( i took it up a few levels to someone that actually knew what the were talking about) hence its a capital gains event . it was an internal broker offmarket transfer ( it wasnt between 2 brokers)
