smsf employer contributions question

I have recently set up a SMSF with Esuperfund.
Today i went to get my employer to start to pay into this fund from now on. But they refused too!!
They said there is somewhere in my award where they will not pay into any other fund but the industry fund im in now. Wouldnt it be my choice of who ever i wanted to go with ie my SMSF???
I believe its against the law for them to refuse. I am correct??
Waiting to ring up ATO and Fair work australia tomorrow about it!
Any thoughts on this?
If it is correct to only way i thought of getting around it is to keep rolling my super into my SMSF.
