I spoke with ETA on proprietary rights and they state that neither do you have proprietary rights.
The court has invoked a stay on this augument.
They say that in the settlement agreement dated 1999 there was an exchange of rights and ownership by contract and they are going froward on the basis they have more rights than you.
My lawyers says this is almost a test case and as you say could go either way. ETA agree but say while the stay remains you are the infringer.
To complex for me. Why don't you phone ETA or the guy Sims and get what they see as the position. I think he leaves for Germany and Africa soon so better be quick.
