Pretty sure LDA converted the last of their options earlier this year. They do hold around 8 million shares on BRN's behalf that were not sold in the first call. Given the nature of our agreement with them I doubt they would be allowed to use those to short the stock.
BRN still need to raise another $9M so will need to use the POA at least once more.
