Victoria's upper house has 40 members, with one Labor member on sick leave granted a voting pair from the opposition - reducing the votes to 38.
There are 16 Labor members and 3 cross benchers who support the Bill - 19 votes.
Somyurek's nay will tie the vote 19 all.
Tied votes are defeated - although watch any moves from shifty Andrews who never ceases to amaze and appall.
