Well, shorting isn't illegal. But it damned well should be!
It's exactly like you own a campervan. You rent it out to some backpackers who drive it all over Australia and completely trash it. They hand it back to you eventually but instead of being able to sue them to recover your loss, the law actually allows the backpackers to keep as profit the difference between the value of the pristine van you rented them and its value after they've trashed it.
This isn't to say there might not be some possible legitimate hedging reasons for shorting. But 'rent with the intent to profit' isn't one of them. It's absurd.
