You need to read my comment properly. In the judgment it was found that because Central did not terminate him on the grounds of the investigation they were unable to subsequently rely on it.

The more information that is available the clearer it is to see why JH didn't think Mr Shortt was the man for the job and that he should be in charge of the dealings. Have to say thank you to 2bob for constantly bringing up the JH issue as without your persistence it may of just been all left behind, the more transparent all this is the better it is for everyone.
